What is the Deceptive Trade Practices Act?

The act is the State of Texas consumer protection law. The purpose is to protect consumers from false, misleading, fraudulent and deceptive business practices. This consumer act protects, as well, small business owners, who can also be defined as consumers, from the deceptive business practices of other business entities or individuals.

Who is a consumer? The term “consumer” includes: An individual, a partnership, a corporation, the state of Texas, or a subdivision or agency of the State, that seeks or acquires goods or services by purchase or lease. The Act does not cover businesses that have assets of $25 million or more, or is controlled by an entity with assets of $25 million or more.

Are you a victim of fraud? The Act protects from unconscionable actions or course of action, breaches of express or implied warranties, and can be used to bring a cause of action in conjunction with many common-law suits. A DTPA action could include breach of contract, breach of warranty, fraud, misrepresentation, and negligence.
